Terms of Service
OChat is a messaging service operated by OC Global Technology Sdn Bhd (“OChat”, “we”, “our”). Please read these terms carefully before using OChat. By creating an account or using the service, you agree to be bound by these terms.
Using OChat
You may use OChat only in accordance with these terms and all applicable laws. You are responsible for any activity that occurs under your account. OChat is intended for personal and professional communication between consenting individuals. The following uses are prohibited without our prior written consent: (a) unsolicited bulk messaging, spam, or unsolicited marketing broadcasts; (b) automated mass distribution of messages or invitations; (c) scraping, indexing, harvesting, or otherwise extracting user data, profiles, contacts, or directory information; (d) reselling, sublicensing, or commercially redistributing access to the service; (e) using the service as a transactional or marketing-broadcast channel to non-consenting recipients.
Your Account
You must provide accurate information when you register and keep your credentials and verification codes secure. You are responsible for maintaining the confidentiality of your account and for all activity under it. Notify us immediately of any unauthorized use at [email protected].
Prohibited Conduct & Objectionable Content
You agree not to upload, post, transmit, or otherwise share content that is unlawful, harmful, or objectionable. Strictly prohibited content and conduct includes, without limitation: (a) any content that sexualizes minors or exploits children; (b) terrorist, violent extremist, or incitement-to-violence content; (c) harassment, bullying, threats, hate speech, or content targeting a person or group based on protected characteristics; (d) impersonation of any person or entity, or misrepresentation of affiliation; (e) malware, viruses, phishing, or other harmful code; (f) spam, unsolicited bulk messaging, or pyramid schemes; (g) intellectual-property infringement; (h) content depicting non-consensual sexual activity, intimate imagery shared without consent, or sexual exploitation; (i) illegal goods, services, or activities under your local law. We have zero tolerance for objectionable content. Violations may result in immediate content removal and account termination, and we may cooperate with law enforcement where required by applicable law.
Content Ownership & License
You retain ownership of the content you send through OChat. You grant us a limited, non-exclusive, royalty-free, worldwide license to process, transmit, store, and deliver that content solely for the purpose of operating the service for you and your intended recipients. We do not claim ownership over your messages, media, or files, and we do not use them for advertising or profiling.
Moderation, Reporting & Filtering
OChat allows users to create, upload, and share user-generated content (UGC). You are responsible for your UGC and must ensure it complies with these terms and applicable law. You may report objectionable content or abusive users in-app from the contact-info or message-options screen, or by emailing [email protected]. We commit to acknowledging reports within 24 hours and removing or restricting confirmed violating content as quickly as practicable. Filtering mechanisms: (a) you may block any user at any time, which prevents further messages and contact discovery from that user; (b) you may mute conversations; (c) you may delete any message you send or receive from your own device. Because some content is end-to-end encrypted, we may not be able to access or review it server-side unless you choose to share evidence as part of a report. We enforce our policies through user reports and human review of evidence submitted by reporters. We reserve the right to remove content, restrict features, suspend, or terminate accounts to protect the safety of our community. Server-visible surfaces we proactively moderate: although message bodies and media are end-to-end encrypted, the following surfaces are visible to our servers and are subject to proactive review and removal when they violate these terms — profile display names, profile photos, profile bios, group names, group icons, sticker pack content and metadata, and any public-facing identifier or directory entry. We may remove, restrict, replace, or reset any of these and we may suspend or terminate the responsible account. We also act on metadata-level signals — including mass-account creation, repeated reports against the same identifier, and ban-evasion via newly created accounts — to restrict or terminate accounts associated with abusive activity. E2EE Filtering Limitations: All 1:1 chats and group chats on OChat are end-to-end encrypted by default. Message content and media are accessible only on the sender's and recipients' devices — not on our servers. As a consequence: (i) we cannot proactively scan, filter, or pre-moderate encrypted content for prohibited material; (ii) automated content classifiers (e.g. CSAM hashing, hate-speech or violent-extremism detection) cannot run server-side against encrypted payloads; (iii) lawful requests for message content cannot be fulfilled in plaintext — we can only produce the metadata we hold (account identifiers, timestamps, and IP logs where applicable). Enforcement therefore relies on (a) reactive user reports that include device-side evidence such as screenshots or forwarded message excerpts, and (b) client-side controls you operate yourself (block, mute, delete, report). You are responsible for using these controls and reporting violations promptly; the absence of automated server-side moderation is an inherent property of end-to-end encryption, not a defect of the service.
Account Deletion & Termination
You may delete your account at any time inside the app via Profile → Delete Account, or by visiting https://ochat.ocgt.app/delete-account, or by emailing [email protected]. We may suspend or terminate your account (and restrict access to the service) if you violate these terms, pose a risk to other users, or if required by law. Where reasonable, we will provide notice and an opportunity to appeal by contacting [email protected], but we may act immediately to prevent harm. Upon deletion or termination, your data is handled in accordance with our Privacy Policy.
Service Availability
OChat is provided on an "as is" and "as available" basis. We may update, suspend, or discontinue features without prior notice and do not guarantee uninterrupted, timely, secure, or error-free access. We do not guarantee that messages will be delivered, transmitted, stored, or received without delay, loss, or duplication.
Limitation of Liability
To the fullest extent permitted by law, OChat and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. The service is provided without warranties of any kind, express or implied. In jurisdictions that do not allow these limitations, our liability is limited to the maximum extent permitted by law.
Age Requirements
OChat requires users to be at least 13 years old to create an account and use the service. Before an account can be created, the signup form requires you to tick a mandatory checkbox confirming you are at least 13 years old and accept these Terms and the Privacy Policy; submission is blocked until it is ticked. OChat is not intended for, marketed to, or directed at anyone under 13. We do not knowingly collect data from anyone under 13; if we become aware that we have, we will delete it promptly. By creating an account, you confirm that you are at least 13 years old. If we discover that an account holder is under 13, we may suspend or terminate the account.
Changes to These Terms
We may revise these terms from time to time. When we make material changes, we will notify you through the app or via email at least 7 days before the changes take effect. Continued use of OChat after the effective date constitutes your acceptance of the updated terms.
Governing Law & Disputes
These terms are governed by the laws of Malaysia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms or your use of OChat shall be resolved exclusively in the courts of Malaysia, except where local consumer-protection law requires the dispute to be heard in your jurisdiction. Nothing in these terms limits any non-waivable statutory consumer rights you may have under the law of your country of residence. Apple App Store — Additional Terms
The following additional terms apply only to OChat installed from the Apple App Store, in accordance with Apple's licensed application end-user license agreement requirements. (a) These Terms are concluded between you and OC Global Technology Sdn Bhd only, and not with Apple Inc. ("Apple"). OC Global Technology Sdn Bhd, not Apple, is solely responsible for OChat and its content. (b) The license granted to you for OChat is limited to a non-transferable license to use OChat on any Apple-branded device that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. (c) Apple has no obligation whatsoever to provide any maintenance or support services for OChat. (d) Apple is not responsible for addressing any claims by you or any third party relating to OChat or your possession and/or use of OChat, including but not limited to product liability claims, any claim that OChat fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection or similar legislation, and intellectual property infringement claims. (e) In the event of any third-party claim that OChat or your possession and use of OChat infringes that third party's intellectual property rights, OC Global Technology Sdn Bhd (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. (f) You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. (g) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Copyright & Intellectual Property Complaints
If you believe content on OChat infringes your copyright or other intellectual property rights, send a written notice to our designated agent at [email protected] including: (a) a physical or electronic signature of the rights owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material with enough detail for us to locate it; (d) your contact information (address, phone, email); (e) a statement that you have a good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights owner or authorized to act on their behalf. We will investigate and may remove allegedly infringing content. Repeat infringers' accounts will be terminated. If your content was removed and you believe it was a mistake or misidentification, you may submit a counter-notice to the same address.
End-to-End Encryption & UGC Moderation
OChat is an end-to-end encrypted (E2EE) messaging service. Because content is encrypted on your device before transmission, OChat servers cannot read, scan, or proactively moderate user-generated content (UGC). To comply with Apple App Store §1.2 and equivalent platform requirements, OChat enforces a pre-signup acceptance gate plus four user-accessible safety pillars, all live inside the app. Pre-signup gating — before an account can be created, the registration form requires the user to tick a single mandatory checkbox confirming they are at least 13 years old and accepting these Terms and the Privacy Policy; submission is blocked until the checkbox is ticked. (a) Filtering — you may delete any received message from your device, mute conversations, clear chat history, and use your device's keyboard or system content filters where available. (b) In-app reporting — every chat header and contact-info screen exposes a Report action. Submit a reason (spam, harassment, inappropriate, fake account, other) and an optional 512-character context note. Reports are submitted directly to our trust-and-safety team. (c) Blocking — every contact-info screen exposes a Block action that prevents further messages and contact discovery from the blocked user. Blocks take effect immediately and persist until you reverse them. (d) 24-hour review SLA — every submitted report is acknowledged and human-reviewed within 24 hours. Confirmed violations result in enforcement action up to and including permanent account termination, in accordance with section 3 (Prohibited Conduct & Objectionable Content). We will cooperate with law enforcement where required by applicable law. You acknowledge that, due to E2EE, our ability to review reported content depends on what the reporter submits as evidence; we cannot retrieve E2EE plaintext from our servers.
